Terms of Service – mySMTP ApS

These Terms of Service (“Agreement”) govern the use of email delivery services (“Services”) provided by mySMTP ApS (“Provider”, “we”, or “us”) via our website www.mysmtp.com. By using the Services, the customer (“Customer”, “you”) agrees to be bound by this Agreement.

  1. Scope and Acceptance

1.1 This Agreement applies to all use of the Services offered by mySMTP ApS, including but not limited to outbound email delivery, IP address provisioning, and associated support services.
1.2 By registering, subscribing, or using the Services, the Customer confirms acceptance of this Agreement and agrees to comply with all applicable laws and industry standards.
1.3 Customers must be at least 18 years old and legally authorized to enter into binding agreements on behalf of themselves or their organization.

  1. Amendments

2.1 We may revise these terms periodically to reflect changes in legislation, business practices, or technology. Any updates will be published on www.mysmtp.com and/or sent to the Customer via email.
2.2 Changes become effective from the date of publication unless otherwise specified.

  1. Term and Termination

3.1 This Agreement takes effect upon acceptance and remains valid until terminated by either party.
3.2 Either party may terminate the Agreement with four (4) weeks’ notice by email.
3.3 Upon termination, all account access is deactivated, and associated data may be deleted, unless retention is required by law.

  1. Right of Withdrawal (EU Consumers Only)

4.1 If the Customer qualifies as a consumer under EU law, a 14-day right of withdrawal applies.
4.2 This right is voided once the Services are accessed or used.

  1. Acceptable Use Policy

5.1 The Services must only be used for lawful, authorized, and ethical purposes. The Customer agrees to comply with all applicable regulations, including:

  • EU GDPR
  • UK GDPR and PECR
  • CAN-SPAM (USA)
  • Local anti-spam, marketing, and consumer protection laws

5.2 Prohibited content includes (but is not limited to):

  • Pornography, sexually explicit content
  • Firearms, ammunition, explosives, knives, or weapons
  • Political campaigning or ideological content without verified consent
  • Hate speech, racism, xenophobia, or incitement to violence
  • Health or medical claims without regulatory approval or scientific evidence
  • Cryptocurrencies or financial schemes not registered or licensed in the relevant jurisdictions
  • Multilevel marketing (MLM), pyramid schemes, “get rich quick” offers
  • Fraudulent invoices, impersonation, or deceptive branding
  • Phishing, malware, trojans, or spoofed sending domains
  • Spam or mass messaging to purchased, harvested, or unverifiable lists

5.3 The Customer is responsible for maintaining consent logs and complying with opt-in and opt-out requirements for all recipients.
5.4 Customer accounts may not be resold, shared, or accessed by third parties unless contractually authorized.
5.5 Violations may result in immediate suspension or termination without notice.

5.7 Inactive dedicated servers (no email activity for 30 consecutive days) may be deleted. Unused credits will be forfeited.

  1. Technical Setup and Service Access

6.1 The Customer is responsible for configuring their own domain, DNS, and authentication records (SPF, DKIM, DMARC).
6.2 mySMTP ApS may make technical changes with 14 days’ notice.
6.3 Although mySMTP aims to ensure high availability, no guarantee is provided for uninterrupted or error-free service.
6.4 The Customer is responsible for backing up any email data or logs needed for their operations or compliance.

  1. Billing and Payment

7.1 Payment methods accepted include credit/debit card, PayPal, MobilePay, and bank transfer via www.mysmtp.com.
7.2 Subscriptions are billed monthly in advance. Additional usage is either billed at the start of the next cycle or deducted from current credits.
7.3 Unused credits do not carry over to the next billing period.
7.4 Dedicated servers inactive for 12 months without new "pay-as-you-go" purchases will incur a server lease fee.

7.6 mySMTP provides up to 2 hours of free onboarding support (e.g., DNS, authentication setup). Additional support is billed hourly as agreed.

  1. Indemnification

8.1 The Customer agrees to indemnify and hold harmless mySMTP ApS, its affiliates, and employees from any claims, liabilities, or damages arising from misuse of the Services, including violation of laws or third-party rights.

  1. Limitation of Liability

9.1 mySMTP ApS is not liable for indirect or consequential damages, including lost revenue or business interruption.
9.2 We are not responsible for outages or failures caused by upstream providers or internet infrastructure.
9.3 Liability is in any case limited to the total amount paid by the Customer in the last 12 months.
9.4 mySMTP is not liable for events outside our control, including but not limited to war, natural disasters, government actions, or internet backbone failures.

  1. Data Protection and Privacy

10.1 mySMTP does not store the content of emails. Metadata (e.g., sender, recipient, timestamp, delivery status) is retained for up to 30 days.
10.2 The Customer is the Data Controller for all data sent through our platform and is responsible for compliance with GDPR or equivalent laws.
10.3 mySMTP implements industry-standard security measures, including spam filters, TLS encryption, and anti-virus scanning.
10.4 mySMTP may contact Customers with important service updates.
10.5 Marketing emails will only be sent based on explicit consent.

  1. Governing Law and Jurisdiction

11.1 This Agreement is governed by Danish law unless otherwise required under mandatory consumer protection laws.
11.2 Any disputes will be resolved by the courts of Copenhagen, Denmark, unless otherwise required by applicable law
